1. Overview

These Terms of Service (“Terms”) govern your access to and use of the Beakology website, online store, and services (collectively, the “Site”). By visiting or purchasing from the Site, you agree to be bound by these Terms and all referenced policies, including our Return & Refund Policy and Privacy Policy.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place orders. By using the Site, you represent that you meet this requirement and are legally able to enter into a binding contract.

3. Product Information and Use

Our products are sealed pet food items intended for small and medium companion parrots. Product descriptions and nutrition information are provided in good faith; however, minor variations may occur. Information on the Site is for educational purposes only and is not a substitute for professional veterinary advice, diagnosis, or treatment. Always consult an avian veterinarian for individualized guidance. Our products may not be appropriate for every parrot, especially if your parrot has known sensitivities or health conditions.

4. Orders, Acceptance, and Availability

All orders are offers to purchase and are subject to our acceptance. We may refuse or cancel any order for reasons including product availability, inaccuracies or errors, suspected fraud or abuse, or noncompliance with these Terms. If we cancel after charging your payment method, we will issue a refund to the original payment method.

5. Pricing, Taxes, and Promotions

Prices are listed in U.S. dollars unless indicated otherwise and may change at any time without notice. Applicable taxes, duties, and fees are your responsibility and will be calculated at checkout when possible. Promotions or discounts are subject to specific terms and may be modified or discontinued without notice.

6. Shipping, Risk of Loss, and Delivery

We ship to the service areas shown at checkout, which may change over time. Shipping timelines are estimates only and are not guaranteed. Title and risk of loss transfer to you upon our delivery of the order to the carrier. Please inspect packages at delivery and follow the Return & Refund Policy for damaged-in-transit issues or fulfillment errors.

7. Returns and Refunds

All sales are final. We do not accept returns for preference issues (for example, if your parrot won’t eat a product). Damaged-in-transit or fulfillment error remedies are available as described in our Return & Refund Policy. By purchasing, you acknowledge and agree to those terms.

8. Feeding Transitions

If your parrot is hesitant with a new food, we’re happy to provide transition tips and feeding strategies. While we offer support, preference issues are not a basis for return or refund.

9. Subscriptions Policy

Beakology subscriptions are designed to make nourishing your parrot simple and consistent. By purchasing a subscription, you agree to the following terms:

How subscriptions work
When you purchase a subscription, your selected products will be automatically billed and shipped at the delivery frequency you choose (for example, every 30 days) until you cancel or modify your subscription.

Billing & renewal
Your payment method will be charged automatically prior to each scheduled shipment. You can view upcoming orders, change delivery frequency, or update payment details at any time through your customer account.

Payment failures
If a payment cannot be processed, we will attempt to retry billing and notify you so you can update your payment method. If payment cannot be completed after multiple attempts, the affected shipment may be canceled and your subscription may be paused or canceled until updated.

Inventory availability
Beakology blends are handcrafted in small batches. If we do not have enough inventory available to fulfill a scheduled subscription order, that shipment may be skipped. Your subscription will remain active, and future deliveries will resume as scheduled.

Cancellations & changes
You may cancel, pause, or modify your subscription at any time before your next scheduled billing date through your account. Changes must be made before the order is processed to apply to the upcoming shipment.

Price changes
Subscription prices may change over time due to ingredient costs or other factors. Any price changes will apply to future shipments only, and we will notify you in advance when possible.

Shipping & returns
Subscription orders follow the same shipping and return policies as one-time purchases. Please refer to our Shipping & Returns Policy for more information.

10. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us promptly of any unauthorized use.

11. User Content and Reviews

If you submit reviews, photos, or other content, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content in connection with the Site and our business, in any media now known or later developed, without compensation. You represent that you own or control the rights to any content you submit and that it does not infringe third-party rights or violate applicable laws. By tagging @Beakology or using our branded hashtags (e.g., #Beakology, #HappyBeaks), you grant Beakology (Arlobird LLC) a nonexclusive, worldwide, royalty-free license to use, repost, and adapt your content in any media, without compensation, with credit at our discretion.

12. Intellectual Property

All content on the Site—including trademarks, logos, text, graphics, and packaging designs—is owned by or licensed to us and is protected by intellectual property laws. You may not use, copy, reproduce, sell, or exploit any portion of the Site or its content without our express written permission.

13. Prohibited Uses

You agree not to use the Site for unlawful purposes; to solicit others to perform unlawful acts; to violate regulations or ordinances; to infringe intellectual property rights; to harass, defame, abuse, or discriminate; to submit false or misleading information; to upload malicious code; to collect others’ personal information without consent; to spam, phish, or scrape; or to interfere with security features of the Site.

14. Allergen, Storage, and Safety Notices

Ingredients may include seeds, grains, botanicals, vegetables, pistachios, and other agricultural products. Store sealed bags in a cool, dry place and reseal tightly after each opening.

15. Disclaimers

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAKOLOGY (ARLOBIRD LLC) AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE; OR (B) ANY PERSONAL INJURY, PROPERTY DAMAGE, VETERINARY BILLS, OR THE INJURY OR DEATH OF ANY ANIMAL ARISING OUT OF OR RELATING TO THE SELECTION, USE, OR MISUSE OF OUR PRODUCTS, OR RELIANCE ON INFORMATION PROVIDED ON THE SITE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR OUR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, OR WHERE SUCH LIMITS ARE OTHERWISE PROHIBITED BY LAW; WHERE PERSONAL-INJURY LIMITATIONS ARE RESTRICTED BY LAW, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

17. Indemnification

You agree to indemnify, defend, and hold harmless Beakology (Arlobird LLC) and our affiliates, owners, officers, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party rights.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Dubuque County, Iowa, for any disputes not subject to informal resolution.

19. Dispute Resolution; Informal Process

Before filing any claim, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve it within 30 days, you may pursue permissible remedies in court as provided above.

20. Changes to the Terms

We may update these Terms at any time. The “Last updated” date indicates the effective date of the current version. Continued use of the Site after changes are posted constitutes acceptance.

21. Severability

If any provision of these Terms is held unlawful or unenforceable, the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with the policies referenced herein, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements or understandings.
